Immigration & Sponsoring Framework: Austria
Detailed statutory guide covering the legal acts, visa pathways, and administrative steps to hire Indian workers.
Immigration Law
Austrian Act on the Employment of Foreign Nationals (AuslBG)
Sponsoring foreign workers in Austria is managed under the Act on the Employment of Foreign Nationals (AuslBG). Sponsoring Indian workers requires obtaining a Red-White-Red Card (Rot-Weiß-Rot – Karte), which is a points-based single permit issued in cooperation with the Public Employment Service (AMS) and the residence authority (Magistrat or Bezirkshauptmannschaft).
Approved Legal Pathways
Red-White-Red Card for Skilled Workers in Shortage Occupations (Mangelberufe)
This is the primary pathway for skilled trades (such as welders, electricians, CNC operators, and caregivers). Sponsoring requires the candidate to score at least 55 points on the RWR assessment grid. Points are awarded for qualifications, specific work experience, language skills (German A1-B1 or English B1-B2), and age. Sponsoring does not require a labor market needs test if the trade is on the official annual national shortage list.
Red-White-Red Card for Other Key Workers (Sonstige Schlüsselkräfte)
For roles not on the shortage list. Sponsoring requires a higher eligibility threshold (at least 60 points) and is subject to a labor market test (Ersatzkraftverfahren) where the AMS checks if a qualified Austrian or EU national can fill the position. Sponsoring also requires paying a statutory minimum gross salary (€3,078/month as of 2025/2026).
Local Integration & Compliance
Meldezettel Address Registration
Within 3 days of entering Austria, the worker must register their residential address with the municipal registration office (Meldebehörde) to receive their Meldezettel. Taj HR pre-vets accommodation locations to ensure address registration is permitted and complies with local tenancy laws.
German Language Course Prerequisites
For many shortage occupations, candidates earn crucial RWR points by proving German language certificates (Goethe or Telc). Taj HR operates a dedicated language school pipeline in India to train candidates up to A2/B1 levels to secure approval on their points audits.
